INTRODUCTION|Breakthroughs in science or technology often raise the of questions whether new law is needed, or whether regulation under old law is sufficient. Frequently, the public debates and wait while agencies regulate by analogy under pre-existing statutes. Does it matter? Can Congress simply undo through legislation any early agency rulemaking based on existing statutes if the demands it? ln other words, does the present structure of afford the cititzenry a constitutionally adequate opportunity to reach democratic consensus on whether new science and technology require new laws?...
