Abstract

This essay's focus is whether extended incarceration on death row is, itself, so cruel and unusual as to implicate Eighth Amendment values and constitute a ground for relief. To answer this question, we must explore, first, the meaning of the cruel and unusual punishments clause, and, second, determine whether the prohibition against such punishments extends to the condition of lingering on death row in circumstances in which the state imposes no other hardship on the prisoner.
