Abstract
INTRODUCTION|A person's fifth amendment right against compulsory self-incrimination has been recognized in a series of Supreme Court cases beginning with Miranda v. Arizona. These Supreme Court decisions have provided the state courts with the standards necessary to resolve fifth amendment challenges. In State v. McNitt, the Nebraska Supreme Court was confronted with a second level Miranda issue. Second level Miranda protection is the procedure that police must follow after an individual exercises his rights by requesting counsel or electing to remain silent.
