FIRST PARAGRAPH(S)|The Nebraska Supreme Court addressed constitutional issues in several cases this year: Nebraska League of Savings and Loan Ass'n v. Mathes was a declaratory judgment action to determine whether a subdivision of the state owns an interest in a savings and loan association in which it deposits funds. This issue raises a constitutional question since a provision of the Nebraska Constitution adopted in 1875 prohibits a city, county, or other subdivision of the state from becoming the owner of the capitol stock in any private corporation or association. The plaintiff, representing Nebraska's savings and loan associations, contended that a deposit of funds in a savings and loan association results in an ownership interest only when the deposited funds become a part of the permanent capital of the association, and are represented by a stock certificate...
