Abstract

FIRST PARAGRAPH(S)|To simply say that there has been a change in the employer/employee relationship in the past ten years is a tremendous understatement. The decline in the traditional protections afforded workers through collective bargaining agreements combined with the assertion of many "new" rights by employees have provided a fertile field for courts and legislatures. This past decade has witnessed the creation of a whole new body of employee rights.|As part of this movement the employment-at-will doctrine, a mainstay in American jurisprudence, has been severely eroded. With states like California and Montana leading the way, many courts are creating a "just cause" standard for employee terminations.
