INTRODUCTION|The Eighth Amendment to the United States Constitution provides: "Excessive bail shall not be required, nor shall excessive fines imposed, nor cruel and unusual punishment inflicted." The treatment an individual receives once he has been convicted and confined to a prison is subject to scrutiny under the Eighth Amendment. Punishment that deprives an inmate of the "minimal civilized measures of life's necessities" is said to be cruel and unusual.
