INTRODUCTION|With its decision in Roe v. Wade, the United States Supreme Court announced the inclusion of a new right into the "right to privacy" category, the right of a woman to have an abortion. There is little doubt that this case is one of the most controversial in the history of American jurisprudence. This controversy is rekindled each time the abortion issue is raised in the courts, which has occurred several times in the fourteen years since Roe. Specifically, the battle has shifted to an examination of permissible state regulation within the Roe framework. Thornburgh v. American College of Obstetricians & Gynecologists represents the most recent attempt by the United States Supreme Court to deal with the implications of the ongoing battle in this area...
