Abstract
INTRODUCTION|Uninsured motorist coverage developed to protect the innocent victims of negligent, financially irresponsible motorists. Recovery under such policies is not possible unless the victim is innocent and the uninsured motorist is negligent. This negligence concept is generally injected into uninsured motorist coverage by a term which requires that the insured be "legally entitled to recover" against the uninsured motorist and which appears in most policies and statutes. The insured victim must prove legal entitlement to recovery and, in the event that the question of such entitlement results in a dispute between the insured and his liability insurer, legal action is frequently necessary...
