FIRST PARAGRAPH(S)|In recent years courts have voiced diametrically opposed views with regard to the issue of whether misconduct by one insured, in violation of an insurance policy provision, voids the policy as to an innocent co-insured who has an interest in the covered property. In Haynes v. Hanover Insurance Co., the Eight Circuit Court of Appeals joined those jurisdictions that permit recovery by an innocent co-insured.|In Haynes, the plaintiffs, as tenants by the entirety, owned a residence in Dunklin County, Missouri, on which Mr. Haynes obtained a homeowner's insurance policy from the defendant, the Hanover Insurance Company. Under the policy, Mr. Haynes was the named insured and Mrs. Haynes was covered as a relative of the insured and a resident in his household.
