INTRODUCTION|The ability of a minority of the members of the Supreme Court of Nebraska to uphold the constitutional validity of legislative acts, even though a majority of the court would strike down the acts, has sprung into prominence recently with the court's decisions in State v. Cavitt and DeBacker v. Brainard.
