FIRST PARAGRAPH(S)|During the survey period, the Nebraska Supreme Court was confronted with constitutional issues arising in two areas of the law. The first area involved regulatory statutes; two cases dealt with that topic. The second area, in which there were also two cases, dealt with constitutional rights in a criminal law context.|REGULATORY STATUTES|Division of School Districts Upheld|In the first case dealing with a regulatory statute, Barnett v. Boyle, the court faced two constitutional challenges to the 1975 amendments to section 79-1103. These amendments provided that the members of the Board of Education in a fifth class school district shall be elected by district. The election commissioner of the county in which the district is located was designated as the party responsible for subdividing the school district. The incumbent members of the school board were authorized to serve until the end of their terms, with elections occuring in the even numbered districts in 1976, and in odd numbered districts in 1978...
