Abstract
INTRODUCTION|During the survey period, the Nebraska Supreme Court faced three very important cases in the area of labor law. The decisions announced by the court should have extensive impact on future determinations in this area.|The most significant decision in the area of labor law was American Association of University Professors v. Board of Regents,I(AA UP), where the Nebraska Supreme Court determined the propriety of the scope and composition of the bargaining units found appropriate by the Court of Industrial Relations.|In AA UP, the petitioner filed for election and recognition as exclusive bargaining agent for a proposed unit of University of Nebraska at Lincoln (UNL) employees. The unit included the full-time academic faculty of UNL, the members of which hold continuous appointments, including chairmen and department directors, but excluding those of higher rank. The unit did not include the faculty of the University of Nebraska at Omaha (UNO), nor the faculty of the University of Nebraska Medical Center (UNMC). Additionally, the petitioner proposed that the unit not include the faculties of either the College of Dentistry or the College of Law. The respondent claimed that the proper unit should be a multi-campus unit, covering all university employees of academic rank, not only those at UNL.
