Abstract

FIRST PARAGRAPH(S)|During the 1998 session of the Nebraska Legislature, LB 1041 was passed and then signed into law by Governor Ben Nelson. The bill had the emergency clause, but it specified an effective date of July 1, 1998, as to all provisions. The primary purpose behind LB 1041 was to bring Nebraska into compliance with the provisions of the Federal Adoption and Safe Families Act of 1997 ("ASFA"). ASFA amended numerous provisions of the Social Security Act tied to federal funding for child welfare programs, which is available to states that are in compliance with federal requirements...
