Abstract
INTRODUCTION|The general rule of aircraft liability is that the owner-lessor of an aircraft incurs no vicarious liability to parties injured because of the negligence of a pilot-lessee. Among the numerous exceptions to this rule is an aviation statute which may impose such liability. In Heidemann v. Rohl, the South Dakota Supreme Court held that the Nebraska aviation statute, which defines "operation of aircraft", imposes vicarious liability on an owner-lessor for the wrongful acts of a pilot-lessee.
