FIRST PARAGRAPH(S)|The Center for Health Policy and Ethics was pleased to work with the staff of the Creighton Law Review in co-sponsoring a conference on "Medical Malpractice in the 1990s." The first three Articles which follow were the main presentations at that meeting. |The point of our conference and of the publication of these papers is to examine questions of medical malpractice in a changing health care environment. Because of changes in reimbursement and advances in techniques, a great deal of health care has moved out of the acute care hospital and into doctor's offices, other outpatient settings, and patients' homes. More Americans are entering nursing homes than ever before and in conditions that might previously have warranted hospitalization. In spite of the lack of an overall national policy, long-term care options have expanded. Managed care arrangements, especially health maintenance organizations, have spread considerably over the last decade. These changes have raised questions about shifting standards of care and refocused foundational issues in the law of medical malpractice...
