Abstract

INTRODUCTION|When a plaintiff is injured and two or more parties are potentially liable for all or part of the damages, questions arise concerning the plaintiff's rights and the rights of the defendants between themselves. With respect to the plaintiff's rights, Nebraska attempts to allow full satisfaction for damages. If a plaintiff is injured by joint tortfeasors he may sue either one or both. If only one is sued he may be held liable for the entire damage because the law regards his act as a cause of the injury. If the injured party obtains a judgment which is satisfied by one of the tortfeasors, he may not collect from the other tortfeasor since Nebraska follows the common law rule that satisfaction of a judgment against one joint tortfeasor bars an action against the other. If the plaintiff receives only partial satisfaction from one tortfeasor, he may sue the other tortfeasor for the remaining amount...
