Abstract

FIRST PARAGRAPH(S)|Throughout the survey period, as in years past, the Nebraska Supreme Court repeatedly confronted and resolved controversy surrounding the area of workmen's compensation. As an arbiter of the conflict between the employer and the employee, stemming from claims for compensation following employee injuries, the court did little to alter the scope of coverage of the Nebraska Workmen's Compensation Act. However, several issues, ancillary to the mechanical operation of the legislation, enabled the court to more clearly delineate evidential principles at work in these cases. Likewise, the Nebraska court was able to reiterate the appropriate standard for the apportionment of attorney's fees in compensation cases involving claims against a third party liable in tort.
