Abstract
INTRODUCTION|In 1974, the Nebraska Legislature passed L.B. 354, designated as the Nebraska Probate Code and scheduled to take effect on January 1, 1977. The Code substantially affects the substantive and procedural approach to probate in Nebraska. In addition, the Code changes the law in related areas such as guardianship, trusts and multi-party accounts.|On October 31 and November 1, 1975, the Creighton University School of Law conducted the Creighton Institute on the Nebraska Probate Code. The Institute, presented with the cooperation of the Nebraska Continuing Legal Education Corporation, was the first of a series of programs to be presented at various locations in Nebraska on the Nebraska Probate Code and related areas. |In an effort to provide an introduction to the Nebraska Probate Code, the Creighton Law Review presents twelve articles which grew out of the presentations at the Creighton Institute on the Nebraska Probate Code. The Institute is not intended as an exhaustive study of the Nebraska Probate Code. Rather, the Institute is intended, in the form of a convenient reference tool, to provide the Nebraska practitioner with a broad understanding of the Nebraska Probate Code. In addition, the material may assist legislators in other states considering the adoption of a version of the Uniform Probate Code. The articles are not presented in traditional law review form. All references to source material are contained in the text of each article rather than in footnotes.
