Abstract

FIRST PARAGRAPH(S)|As Judge Novicoff has stated and as indicated on the program, I am going to discuss lump sum settlements. Since I am aware that there are quite a few representatives from insurance companies, from time to time I will digress a little to give these particular members of the audience an idea of how the compensation court is operated and how we try to be cooperative and extend help in the various causes that come before us.|Lump sum settlements are probably one of the most important segments of the law of workmen's compensation from the standpoint of the employee and from the standpoint of the employer. However, this is probably one of the most misunderstood areas in workmen's compensation law, as is evidenced by the proposed lump sum settlements which are submitted to the court. Accordingly, I will try to explain what the court requires in lump sum settlements, and I will do this by pointing out many of the errors that are committed by an attorney in drawing up these types of settlements. Frequently, the proposed settlements have to be returned to the attorney because of the errors committed in drawing up the settlements. We know that this is irritating, but we also know that when a lump sum settlement is made, the attorney wants to be certain that it is valid...
