Abstract

INTRODUCTION|In 1983, trust deeds were emerging in Nebraska as a security device on real estate loans in place of mortgages. At that time, I authored an article entitled "Trust Deeds Come of Age in Nebraska: A Survey and Analysis." A decade later, trust deeds have become the security device of preference over a mortgage in Nebraska and predominate the real estate loan market. During the interim, there have been a number of legislative changes and judicial decisions relating to the Nebraska Trust Deeds Act. In addition, Nebraska has enacted legislation governing servicing of loans secured by trust deeds or mortgages.
