FIRST PARAGRAPH(S)|During the past year the Nebraska Supreme Court considered several issues in the area of administrative law. Most of these decisions did little to alter existing Nebraska law. The court did, however, elaborate on the proper application of the phrase "arbitrary and capricious" as it applies to the responsibility of various state agencies in creating their respective rules and orders.|In Nebraska Railroads of Omaha v. Nebco, Inc., the Nebraska Supreme Court affirmed a Public Service Commission order authorizing an identical rate increase for intrastate railway traffic as had been authorized by the Interstate Commerce Commission for interstate traffic.
