Abstract
INTRODUCTION|The search for fairness and effectiveness has inspired reformers of the criminal code over the past two decades. In recent years, society has become increasingly concerned with the problems in the criminal justice system. Because the system of criminal law protects the most important societal interests and calls for the most stringent sanctions, a criminal code should be rational, unambiguous, and internally consistent. A precise and unambiguous criminal code that sufficiently defines unlawful conduct is necessary for society to achieve its goals of condemnation and deterrence. Such a code gives society and its individual members fair warning as to what will constitute a crime, places limitations on governmental discretion in determining violations of the law, and creates the basis of a fair sentencing system by delineating distinctions among degrees of harm...
