INTRODUCTION|The Nebraska law governing a landowner's right to use underground water has been based on dicta and conjecture by judges and scholars alike. In the recent case of Prather v. Eisenmann, the Nebraska Supreme Court clarified Nebraska law on ground water use, and also determined the effect of the Preferential Use Statute on competing users who are on different preference levels.
