Abstract

FIRST PARAGRAPH(S)|During 1979 the Eighth Circuit Court of Appeals handed down many decisions in the area of criminal law. These decisions dealt with bank robbery, specific intent, double jeopardy, jury trials, telecommunications, fraud, the duress defense, and conspiracy. The more significant decisions in this area are highlighted below.|Title 18 of the United States Code section 2113(a) makes it a crime to enter a bank with the intent to commit a felony, such as bank robbery. In a case decided nearly forty years ago, Audett v. United States, the phrase "enter or attempt to enter any bank" was upheld by the Eighth Circuit Court of Appeals against a contention that "enter" was too vague and failed to define the conduct Congress had sought to penalize. Enter was construed to include walking in the front door with other customers, or prying open the back door in the middle of the night...
