FIRST PARAGRAPH(S)|During the survey period the cases of United States v. Anderson and United States v. Spero, were decided, and they reveal the Eighth Circuit's position on two issues which have caused a division among the circuit courts. The issue in Anderson involved the statutory definition of the term "enterprise" as used in the Racketeer Influenced and Corrupt Organizations Act (RICO). Spero involved the extent to which Rule 609(b) of the Federal Rules of Evidence compels a district court judge to make an explicit finding regarding the probative value of a conviction over ten years old.
