INTRODUCTION|Conservation and regulation of our diminishing natural resources are matters of great public concern. Along with the increased public need to control the development of these resources, the rights of those holding interests must be protected. For example, A, B, and C own adjoining lots, beneath which lies a single oil reservoir. Each adjoining owner has a right to an equitable share of the oil produced from the reservoir. However, this right is restricted by the state's interest in conserving oil resources. State regulations limit the oil produced from each reservoir by prescribing the location and number of wells. If only A is permitted to drill a well, then B and C should have protection for their right to a share of the oil produced...
