Abstract

INTRODUCTION|While this work was in its formative stages, Justice Brennan announced his retirement from the Supreme Court of the United States. As the author of Monell v. Deptartment of Social Services, and many of the cases fleshing out that decision, Justice Brennan has clearly been the Court's most significant contributor to the development of the law of local government liability under 42 U.S.C. section 1983. In Monell, the Supreme Court overruled Monroe v. Pape, to the extent that Monroe had held that municipalities could not be sued as "persons" under section 1983.
