INTRODUCTION|Trust deeds are a security device that can be used in place of a mortgage or a land contract in a typical real estate transaction. In Nebraska the use of trust deeds is governed by the Nebraska Trust Deeds Act. Although this Act was originally enacted in 1965, trust deeds have not been used with great frequency in Nebraska until recently. However, most of the major mortgage lenders in Nebraska are beginning to utilize trust deeds instead of mortgages. Thus, the Nebraska Trust Deeds Act is becoming more important to the Nebraska practitioner in real estate and finance law.
