Abstract

FIRST PARAGRAPH(S)|In Maddox v. First Westroads Bank, the Nebraska Supreme Court addressed a number of issues involving the interpretation of provisions of articles 3 and 4 of the Uniform Commercial Code. Damages were sought against two banks, First Westroads Bank ("Westroads") and Center Bank, on the grounds that the plaintiffs' savings accounts at Westroads had been improperly charged due to forged withdrawal slips and the payment of forged cashier's checks. The facts before the trial court upon motions for summary judgment were as follows. An individual representing himself as the attorney for the guardian of the plaintiffs, who were the beneficiaries of life insurance policies, opened savings accounts at Westroads in the name of the guardian. Insurance checks bearing the typewritten endorsement of the guardian were deposited in the account by the attorney. Westroads did not obtain a signature card from the guardian...
