Abstract

FIRST PARAGRAPH(S)|In 1980, the Eighth Circuit Court of Appeals decided questions of constitutional law that were on the leading edge of constitutional jurisprudence. Beginning this survey are two cases which involve questions of statutory construction and equal protection of the laws as they relate to the Federal Medicaid Act, the Hyde Amendment, and state obligations to fund abortions: Reproductive Health Services v. Freeman and Hodgson v. Board of County Commissioners. Following that discussion, two cases dealing first amendment freedoms of speech and association, and free exercise and establishment of religion clauses as they relate to activities conducted by the public schools, or on such property are considered: Flory v. Sioux Falls School District 49-56, and Vincent v. Widmar. Finally, included in this article are two cases that concern due process guarantees as they relate to employment rights: Fowler v. United States and Carrei v. Metropolitan St. Louis Sewer District...
