INTRODUCTION|The rental payments generated from a commercial real estate project, such as a shopping center or an apartment complex, are often the primary source of repayment of a debt secured by the real estate. Although rent payments would appear to be personal property and otherwise subject to the provisions of Article 9 of the Uniform Commercial Code, an interest in a lease of real property and rent payments are excluded from the scope of Article 9.
