Abstract
INTRODUCTION|In his first state of the union address, President George Bush warned drug criminals: "If you are caught and convicted, you will do time." For some prisoners, their "time" could be quite profitable. In 1980, provisions were made under the Social Security Act for disabled individuals, convicted of either state or federal felonies, to receive social security benefits during their incarceration. Despite national concern over deficit spending, the federal government is paying a salary to incarcerated felons in the form of social security benefits. This pillage of the federal treasury cannot continue. Accordingly, Congress should amend 42 U.S.C. section 402(x)(1) to prohibit social security disability benefits to prisoners...
