FIRST PARAGRAPH(S)|Last term, the supreme court left unclear the issue of a broker's right to a commission by citing, but refusing to apply, prior case law wherein a broker's fees were withheld because the broker breached his fiduciary duty to the seller. Brezina v. Hill concerned a conflict between a real estate broker and a seller. In that case the broker received an offer in excess of the price specified in the listing contract. The seller refused to accept the offer. In spite of that refusal the broker signed the purchase agreement as broker for the seller, filed it with the county register of deeds, and told the buyer that the contract was binding...
