INTRODUCTION|The trend in tort law has been toward a system of loss distribution among joint torfeasors based on their proportionate share of fault. At common law there was no mechanism for loss distribution between joint tortfeasors. If a plaintiff was injured by joint tortfeasors, the plaintiff had a right to sue either one or both. If only one of the joint tortfeasors was sued and the injured party obtained a judgment which was satisfied by the defendant tortfeasor, the tortfeasor who paid the entire judgment was unable to recoup anything from the other tortfeasor...
